Terms of Use

1. Acceptance of These Terms
These Terms of Use apply to all users of MindWard, published on the Apple App Store by MARS Studio. By downloading and using the app, you acknowledge that you have read, understood, and agreed to these terms. If you do not agree, do not use the app.
2. License
MARS Studio grants you a personal, non-transferable, non-exclusive, revocable license to use MindWard on Apple devices that you own or control, for your personal, non-commercial use, in accordance with these terms and Apple's App Store terms. You may not copy, modify, distribute, sell, lease, reverse-engineer, or attempt to extract the source code of the app, except to the extent permitted by applicable law.
3. Free Plan
MindWard's free plan includes 100 notes, 10 voice memos, 2 mind maps, 15 vault items, and unlimited tasks. Creating new items beyond these limits requires a MindWard Pro subscription. Reaching a limit never locks you out of your data: reading, editing and export always work, even over the limits.
4. MindWard Pro (Auto-Renewable Subscription)
MindWard Pro removes the free plan limits. It is an auto-renewable subscription offered at $2.99 USD per month or $19.99 USD per year. Prices shown in the App Store are authoritative and may vary by region.
- Payment is charged to your Apple Account at confirmation of purchase.
- Auto-renewal. The subscription automatically renews at the then-current price unless auto-renewal is cancelled at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours prior to the end of the current period.
- Managing or cancelling. You can manage your subscription or cancel auto-renewal at any time after purchase in your Apple Account settings (Settings › [Your Name] › Subscriptions). Cancellation takes effect at the end of the current paid period.
- Refunds. All payments are processed by Apple. MARS Studio cannot directly issue refunds; refund requests are subject to Apple's standard refund policy via reportaproblem.apple.com.
Your use of MindWard is also governed by Apple's Licensed Application End User License Agreement (Standard EULA): apple.com/legal/internet-services/itunes/dev/stdeula.
5. Referral Program
MindWard includes a referral program: you may share your referral code with a friend, and when they redeem it, both of you receive 30 days of MindWard Pro. Referral rewards are capped at 6 earned months per year per user. The referral program is offered at MARS Studio's discretion; we may modify or discontinue it, and we may revoke rewards obtained through fraud or abuse (for example, self-referral or automated redemption).
6. Your Data, Your Responsibility
MindWard stores your data on your device and in your own iCloud (your private database), and is designed with a safety net: notes keep version history, deleted items stay in trash for 30 days, a backup file is written to the Files app weekly, and Back Up Now is available any time. Nevertheless, you acknowledge that:
- You are responsible for maintaining your own backups of important information independently of the app.
- Sync and restore depend on your iCloud account: you are responsible for keeping access to your Apple account and sufficient iCloud storage.
- Vault items are end to end encrypted with keys that never leave your Apple account. If you lose access to your Apple account, vault contents cannot be recovered by MARS Studio or by Apple.
- Items emptied from trash after the 30-day window are gone.
7. Apple Services
MindWard relies on Apple services that you control: iCloud (CloudKit) for sync and storage, iCloud Keychain for vault key storage, Face ID or your device passcode for vault unlock, and Apple's on-device speech recognition for voice memo transcription. You acknowledge that:
- iCloud, iCloud Keychain, Face ID, and the App Store are trademarks of Apple Inc. MindWard is not affiliated with, sponsored by, or endorsed by Apple.
- Your use of iCloud remains governed by Apple's own terms and policies.
- Apple controls these services. Changes to their availability or behavior may limit or change MindWard features, and MARS Studio is not responsible for such changes.
8. No Warranty
MindWard is provided “as is” and “as available”, without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. MARS Studio does not warrant that the app will be uninterrupted or error-free, that on-device transcription will always succeed or be accurate, or that iCloud sync will always be available.
9. Limitation of Liability
To the maximum extent permitted by applicable law, MARS Studio, its founders, developers, and affiliates shall not be liable for any loss or damage, including direct, indirect, incidental, consequential, or data-loss damages, arising from your use of or inability to use MindWard, including any loss of notes, tasks, mind maps, voice memos, vault items, or backups. Nothing in these terms excludes liability that cannot be excluded under applicable law.
10. Regional Notice
This app is available globally. Local laws and regulations regarding data storage and consumer software vary by country. It is your responsibility to ensure that use of this app complies with the laws of your jurisdiction.
11. Changes to These Terms
We may update these terms from time to time. Material changes will be reflected in the “Last updated” date above. Continued use of the app after any changes constitutes your acceptance of the updated terms.
