1. Acceptance of Terms
By downloading and using DhyanaMala, published on the Apple App Store by MARS Studio, you acknowledge that you have read, understood, and agreed to these terms. If you do not agree, please discontinue use of the app.
2. Purpose & Nature of Content
DhyanaMala is a spiritual and educational tool designed to support mantra chanting and meditation practice. Specifically:
- All mantras are provided for personal spiritual practice and educational purposes only.
- The app is not affiliated with any specific religious institution, temple, or spiritual organization.
- Content is curated from widely available traditional sources and presented in good faith.
- MARS Studio does not claim any religious authority or make any spiritual guarantees.
3. Accuracy of Content
We take great care to ensure accuracy of the Sanskrit text, transliterations, and translations included in DhyanaMala. However:
- Sanskrit is an ancient language with regional variations in pronunciation and interpretation. Minor differences from other published versions may exist.
- Transliterations are simplified for accessibility and may not capture every phonetic nuance of the original Sanskrit.
- English translations convey the general meaning and may not reflect the full depth of the original text.
- Text-to-speech pronunciation is generated by Apple's on-device engine and may not perfectly replicate traditional Sanskrit recitation.
4. License
MARS Studio grants you a personal, non-exclusive, non-transferable, revocable license to use DhyanaMala on your Apple devices in accordance with the Apple App Store Terms of Service. You may not:
- Redistribute, sublicense, or sell the app or its content
- Reverse engineer, decompile, or disassemble the app
- Use the app's content for commercial publication without written permission
5. Intellectual Property
The app design, user interface, code, and original editorial content (descriptions, categorization, translations) are the intellectual property of MARS Studio. The mantras themselves are part of the ancient Hindu spiritual tradition and are not claimed as proprietary content.
6. Health & Wellness Disclaimer
DhyanaMala is a meditation and chanting aid. It is not a medical device or therapeutic tool:
- The app does not provide medical, psychological, or therapeutic advice.
- Meditation and chanting practices should complement, not replace, professional medical care.
- If you experience any physical or psychological discomfort during meditation, please consult a healthcare professional.
7. Limitation of Liability
To the maximum extent permitted by applicable law, MARS Studio, its founders, developers, and affiliates shall not be liable for any loss or damage, including direct, indirect, incidental, or consequential loss, arising from your use of or reliance on DhyanaMala or any content it provides.
8. Disclaimer of Warranties
The app and all content, data, and features it provides, including mantra texts, transliterations, translations, and text-to-speech audio, are supplied "AS IS" and "AS AVAILABLE", without warranty of any kind, express or implied, including, without limitation, warranties of merchantability, fitness for a particular purpose, accuracy, completeness, timeliness, non-infringement, and uninterrupted or error-free availability. The app or its features may be interrupted, degraded, or discontinued at any time. Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you; in that case any implied warranty is limited to the minimum scope and duration permitted by applicable law.
9. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless MARS Studio and its founders, developers, and affiliates from any claim, loss, liability, or expense (including reasonable legal fees) arising from your breach of these terms or your misuse of the app.
10. Governing Law & Dispute Resolution
These terms are governed by the laws of Japan, without regard to conflict-of-law rules. Nothing in this clause deprives you of any mandatory consumer protections of the law of the country in which you reside. Before pursuing any formal claim, you agree to first contact us at dm-privacy@marsstudio.app and allow 30 days for us to attempt to resolve the issue informally.
11. Severability
If any provision of these terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.
12. Changes to These Terms
We may update these terms from time to time. Material changes will be reflected in the "Last updated" date above. Continued use of the app after any changes constitutes your acceptance of the updated terms.
