1. Acceptance of Terms

By downloading, installing, or using Nestward (the "app"), you agree to these Terms & Disclaimer. If you do not agree, do not use the app. These terms are between you and MARS Studio ("we", "us").

2. What Nestward Is

Nestward helps a family or group of friends coordinate everyday life — shared to-dos and calendar, money and allowances, places and travel, an encrypted document vault, group chat, optional location presence, and optional elder-care wellness check-ins. It is an organisational convenience tool, used among people who have chosen to coordinate with each other.

3. Not an Emergency, Safety, or Medical Service

This is the most important term. Nestward is not a safety, security, monitoring, or medical device or service:

• Location presence is best-effort and depends on devices, networks, battery, and Apple's iCloud. It may be delayed, stale, or unavailable, and it is not real-time tracking.
• The elder-care wellness check-in is a gentle, non-clinical "I'm OK" prompt. It is not a medical alert, fall detector, or emergency response system, and it makes no medical assessment.
• In an emergency, contact your local emergency services. Do not rely on Nestward for anyone's safety or wellbeing.

4. Your Responsibilities

• Only invite people who consent to coordinating with you, and respect their choices about what they share.
• If a child participates, you confirm you are their parent or guardian (or have that person's authority) and provide consent on their behalf. Do not enable a child's location sharing without proper parental consent.
• Use the app lawfully. Do not use it to surveil, stalk, harass, or coerce anyone, or to share another person's information without their consent.
• You are responsible for the accuracy of the information you enter.

5. Location Sharing

Location sharing is opt-in and consensual. Family sharing is ongoing presence; Friends sharing is time-boxed and expires on its own. A sharing indicator is shown while you share, and you can pause or stop at any time. Location is shared only with members of your group, through your iCloud, and is never sent to us. Availability and timeliness are not guaranteed.

6. Your Data & iCloud

Nestward has no server operated by MARS Studio. Your data lives on your device and in your own Apple iCloud, shared (via Apple's CKShare) only with members you invite. As a result:

• Sync, sharing, and availability depend on Apple's iCloud service and your — and your group members' — iCloud accounts, devices, and settings.
• We cannot access, recover, restore, or export your data on your behalf.
• You are responsible for maintaining your own device backups (e.g. iCloud Backup).

7. The Encrypted Vault

The document vault is end-to-end encrypted with a key stored only on your device. Neither other members nor MARS Studio can decrypt your vault. If you lose access to your device and its Keychain, vault contents are permanently unrecoverable — this is a deliberate privacy design, and we cannot recover them for you.

8. No Financial, Legal, or Medical Advice

Bills, budgets, allowances, and shared-expense features are organisational tools, not financial, accounting, tax, legal, or medical advice. Settle-up suggestions are informational. Always rely on your own judgement and qualified professionals for important decisions.

9. Acceptable Use & Content Moderation

You agree not to reverse-engineer, disrupt, or misuse the app, and not to use it for any unlawful, harmful, or rights-infringing purpose. We may suspend or discontinue features at any time.

There is no tolerance for objectionable content or abusive behaviour in Nestward's group chat or any shared space. Offensive language is filtered automatically; any member can report a message or block another member (blocking hides that member's content immediately). Reports come to MARS Studio, and we act on them within 24 hours — removing content that violates these terms and, for repeated or serious offences, removing the responsible member's content and access. Details of what a report contains are in the Privacy Policy, Section 2.

10. Intellectual Property

The app, its name, design, and content (excluding the data you create) are owned by MARS Studio and protected by applicable law. You receive a personal, non-exclusive, non-transferable licence to use the app under these terms and the Apple App Store terms.

11. Disclaimer of Warranties

The app is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, availability, and non-infringement. We do not warrant that the app will be uninterrupted, timely, secure, or error-free.

12. Limitation of Liability

To the maximum extent permitted by law, MARS Studio is not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of (or inability to use) the app — including any reliance on location, presence, notifications, or check-in features. Nothing in these terms excludes liability that cannot be excluded by law.

13. Children

Children may participate in a family group only under the control and consent of a parent or guardian, as described in Section 4 and the Privacy Policy. We do not collect data from children — there is no MARS Studio server.

14. Changes to the App & These Terms

We may update the app and these terms over time. Material changes to these terms will be reflected by the "Last updated" date above and, where material, surfaced in the app. Continued use after changes constitutes acceptance.

15. Governing Law

These terms are governed by the laws of Japan, where MARS Studio is based, without regard to conflict-of-laws principles. Mandatory consumer-protection rights in your country of residence are unaffected.
